Qualche giorno fa, senza riuscire a trattenere un sorriso, ho letto una buffa dichiarazione dell’Associazione Nazionale Esperti Infortunistica Stradale, secondo cui la riforma della giustizia civile in via di approvazione vorrebbe consegnare l’assistenza legale stragiudiziale nelle mani degli avvocati, “favorendo ancora una volta la lobby degli avvocati” (proprio così: “favorendo ancora una volta” e “la lobby degli avvocati”!).
Innanzitutto, non vedo cosa ci sia di così scandaloso nel fatto che siano gli avvocati i soggetti scelti dal legislatore per fornire l’assistenza legale stragiudiziale ai cittadini: poiché questi poveruomini hanno studiato presso un’università di giurisprudenza per cinque anni, nel corso dei quali hanno sostenuto trenta esami di diritto, hanno poi svolto due anni di pratica forense, hanno infine affrontato e superato un esame scritto della durata complessiva di oltre venti ore vertente su materie giuridiche e un esame orale avente ad oggetto circa quattromila pagine che parlano di legge, direi che gli avvocati hanno tutto il diritto (ah ah!) di essere considerati i professionisti maggiormente qualificati ad offrire la consulenza stragiudiziale ai cittadini.
Quanto alla “lobby degli avvocati”, favorita “ancora una volta”, chiederei cortesemente ad una qualsiasi persona che non viva in un legal thriller di John Grisham ma sulla Terra, di delinearmi bene i contorni e l’influenza di questa lobby e di elencarmi tutte le numerosissime volte in cui questa potentissima lobby è stata favorita, perché io, invece, faccio parte di una categoria che nella stragrande maggioranza dei casi è alle soglie della povertà, paga cifre esorbitanti per i contributi previdenziali, è soffocata dalla concorrenza e dagli incombenti, viene ritenuta dal legislatore – nemmeno troppo nascostamente – come la causa di tutti i mali della giustizia (potete mettere tutti i filtri che volete al processo: mediazione, negoziazione, salto in un cerchio infuocato, ma non sono gli avvocati a non accordarsi e a voler fare le cause, sono i clienti; se volete cambiare la giustizia, dovete cambiare l’umanità, non eliminare gli avvocati), anche se poi è proprio sulla nostra categoria che si scaricano tutti i malfunzionamenti della giustizia medesima (prendiamo il periodo feriale dei magistrati, che dovrebbe essere ridotto: i giudici continueranno a rinviare le udienze ignorando la riduzione del periodo feriale perché il calendario delle udienze lo gestiscono a loro discrezione, l’unico effetto sarà che tra un’udienza e l’altra scadranno più velocemente i termini per il deposito delle memorie, e quindi gli unici a lavorare di più d’estate saranno gli avvocati).
Ma la cosa che mi colpisce maggiormente è questo affanno e questa pervicacia con cui diverse categorie aspirino a sostituirsi agli avvocati. Non ad altre categorie, solo agli avvocati.
I fruttivendoli non hanno mai preteso di operare a cuore aperto, né i bagnini di progettare grattacieli. Ma tutti, chissà perché, pretendono di fare gli avvocati. Esperti di infortunistica stradale, commercialisti, geometri, amministratori di condominio, bancari, ragionieri, notai, giornalisti. Tutti si sentono avvocati.
Tutti, in fondo, sono avvocati.
E io credo di sapere il motivo: perché, sotto sotto, credono che invece funzioni proprio come in un legal thriller di John Grisham, come in un film in cui Tom Cruise torchia Jack Nicholson, come se la professione di avvocato fosse, in fondo, solo un bel vestito e tante parole, come se non servissero tutti quegli anni di studio e di preparazione per difendere adeguatamente una persona.
Vi svelo un segreto: Tom Cruise non è un avvocato. Ma neanche Marco Travaglio, per dire.
